It is illegal firehead. It's displayed everywhere when you are given the chance to download anything. Unless you own the game, I don't think it;s illegal.

Actually, the only way it is legal is if you have a copy of the game, for if you buy the game and don't have the system than it is legal. If you don't have the game roms are used as 'previews', and you can own a rom for a day, but after that day you must delete it or it is legal.
As far as I know . . .

That is false. ROMs aren't legal even if you only have them for only twenty-four hours, and even if you do own the game it will only be legal if you make the backup yourself. Source: www.gamefaqs.com/features/help/hmisc_1.html
